Terms of Use (Integrated: Mosslab Store + Moss Echo App/Device)

These Terms apply to the mosslab.com website and online store (the “Site”), the Moss Echo mobile application (the “App”), and the Moss Echo device and related services (collectively, the “Service”) provided by Taiga global Inc. (the “Company”) and its affiliates. By using the Service, you are deemed to have agreed to these Terms and to our Privacy Policy.

1. Scope of Service & Priority of Terms

These Terms apply to the Site (content viewing, e-commerce), the App (software use), and the device (Bluetooth pairing, firmware guidance).
For software use of the App/Device, the “App License (EULA)” section prevails.
For commerce (orders, payment, shipping, refunds), the “Orders/Payment/Shipping/Cancellation/Returns/Refunds” section applies.

2. Eligibility, Accounts, Age

You represent that you are at least the minimum digital-consent age required in your country (e.g., 13 in the U.S. (COPPA), 16 in the EU unless a Member State sets 13–15, 14 in Korea for online services guidance).
If you are under the age of majority in your country (e.g., 18), you must have parental/guardian consent to use the Service, and purchases must be made by—or with the consent of—your legal guardian.

3. Intellectual Property

“Moss Echo,” “Mosslab,” the logos, UI of the App/Site, images, text, audio, and other content are the Company’s rights. You may not reproduce, distribute, or create derivative works without prior written consent.

4. Site Use (Content License)

We grant you a limited, revocable license to temporarily view/download Site materials for personal, non-commercial use.
Prohibited: modifying/copying materials; commercial use/public transmission; reverse-engineering; removing copyright notices; mirroring.
If you violate these restrictions, the license terminates automatically and you must destroy any downloaded materials.

5. Links, Changes, and Errors

The Site may include links to third-party websites; we are not responsible for their content or accuracy.
Site materials may contain technical/typographical errors and may be changed without notice (no guarantee of currency).

6. App License (EULA)

We grant a personal, non-exclusive, non-transferable, revocable license to install/use the App on devices you own or control.
Prohibited: reverse engineering, decompilation, disassembly; unauthorized copying/distribution/resale; bypassing security; data scraping; violations of applicable law.
Some App/Device features may require the latest OS/firmware.

7. Device Pairing & Third-Party Services

The App relies on OS features and Bluetooth/Local Network to connect with the Moss Echo device. Availability may vary by network/environment/model.
We are not liable for interruptions/limitations caused by third-party platforms or services.

8. Permissions & Notifications

Depending on device/OS, the App may request:

Bluetooth: pairing and mode/audio control

Local Network (optional): device discovery on the same network

Notifications: alarms and sleep timer alerts
Refusing permissions may disable certain features (you can change this in Settings).

9. Health & Safety (Not a Medical Device)

The Service supports relaxation, sleep, and meditation experiences but is not a medical device nor medical care. If you have sleep disorders, photosensitivity, respiratory issues, or other concerns, consult a professional. Use the device/power adapter safely and keep them away from children.

10. User Content

You retain rights to content you upload/input (e.g., profile names, images, playlists). You grant the Company a worldwide, royalty-free, non-exclusive, sublicensable license to use such content solely to operate and improve the Service. Do not post infringing, unlawful, harmful, spam, or malware content; we may remove or restrict violations.

11. Updates

App updates and/or device firmware updates may be provided or required for security, performance, or compliance. Some features may work only on the latest versions.

12. Orders/Payment/Shipping/Cancellation/Returns/Refunds (E-commerce on the Site)

E-commerce Platform: We use Shopify; payment security/processing/data handling follow Shopify policies.
Orders/Payment: Once processing/shipping has begun, changes/cancellations may be limited.
Shipping: Timing/costs/customs (for international) are disclosed at checkout or on info pages; shipping risks/damage follow carrier policies (subject to mandatory consumer laws).
Cancellation: Contact support@mosslab.com promptly; cancellation may be unavailable after processing/shipment.
Returns/Exchanges: Request within 14 days of receipt (unused/unopened/original packaging; see policy page). Exchange/refund follows pickup and inspection.
Refunds: If approved, refunds go to the original payment method; card/payment processors may take extra time.
Not Eligible: Final sale/custom items; broken seals; missing components; signs of use; damage due to customer fault, etc., as stated in policy.
Warranty/After-Sales: Subject to product-specific warranty policy and applicable laws.
Customer Service: support@mosslab.com (orders/cancellations/returns/refunds).

13. Privacy

Handling of personal data (collection/use/storage/sharing) follows our Privacy Policy (link: ▲https://shop.mosslab.com/pages/privacy-policy). We process only what is necessary for e-commerce and App features.

14. Disclaimer

The Service is provided “as is” and “as available.” We disclaim express/implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not guarantee uninterrupted/error-free operation or compatibility with all devices/OS.

15. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential damages, data loss, business loss, or damages caused by third-party service failures. Our aggregate liability will not exceed the amount you actually paid (if any) for the Service in the three months preceding the claim. Mandatory consumer protection laws prevail.

16. Suspension/Termination

You may end use at any time by deleting the App or closing your account. We may suspend/terminate for violations, unlawful acts, or security risks. Upon termination, the license in Section 6 ends.

17. Changes to Terms

The Company may amend these Terms and will provide notice at least 7 days before the effective date (30 days for material changes) via notices on the Site or in the App, and may additionally notify account holders by email.

18. Governing Law & Venue (Option 1: generalized operating jurisdiction)

All claims relating to the Service are governed by the laws of the jurisdiction where Mosslab operates, without regard to conflict-of-law rules. Venue lies in the courts located in the jurisdiction where Mosslab operates. Mandatory consumer protection laws of your residence, if applicable, take precedence.
